Consent to Establish

As per provisions of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 all new intending projects (Developmental & Industrial) are required to obtain “Consent to Establish”(popularly termed as NOC) from State Pollution Control Board.Consent to Establish can be obtained by applying to Board with adequate fees and requisite documents and information through online services.

Depending upon the pollution and hazard potential of industrial activities, the industries are categorized as Red , Orange, Green and White. The industrial projects are further classified into Category A, Category B and Category C as follows on the basis of investment and pollution potential.

The Board has delegated powers to officers at Head Office as well as Regional officers in the matter of grant of consent to establish as follows:

Regional Office Regional Officer i) Other than 17 category of polluting industries (Red-A) i.e Red-B, Orange and Green having investment uptoRs. 50 crore.

ii) Mines other than coal, Bauxite, Iron Ore, Manganese, Limestone, Dolomite & Chromite.

All projects with investment of Rs. 1000 crore or more and miens with lease hold area of 1000 Ha. or more will be evaluated by consent committee after appraisal by Technical.

*Distillery (including Fermentation), Sugar (excluding Khandasari), Fertilizer (Basic), Pulp and Paper, Chloralkali, Pharmaceuticals, Dyes and Dye-intermediates, Pesticides (Technical), Oil Refinery, Tanneries, Petrochemicals, Cement, Thermal Power, Iron & Steel, Zinc smelter, Aluminium smelter & Copper smelter.
